Tramshop

Conditions

Article 1
A contract for the sale of any item will exist between customer and Tramshop as soon as the customer accepts a confirmation e-mail. This confirmation e-mail amounts to an acceptance by Tramshop of customer's offer to buy goods.
Article 2
"Tramshop" shall have no liability to the customer for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events, and also including acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment. If any of these occurrences happen, the customer is allowed to cancel the order after a period of five working days without any further costs, unless the abovementioned occurrences have happened within the realm of the customer.
Article 3
If for any reason an ordered item will no longer be available, Tramshop will notify customer as soon as possible by e-mail. Customer is allowed to cancel the order without further costs.
Article 4
Customer must check the ordered items as soon as possible. If any item is defective, customer must state this by e-mail to Tramshop within a period of ten working days after receiving the item. Complaints or claims made after this ten-day period will not be honored.
Article 5
Tramshop will not be liable to customer for any loss or damage caused by improper use of the ordered items by customer.
Article 6
Deliveries will be made after payment is received by bank transfer, unless a written payment alternative has been agreed. In case a different way of payment is agreed, the money must be received within the contractual period for payment. After this time, customer has to pay the official interest rate. Delivery follows after Tramshop has received the payment in full.
Article 7
Packages will be sent by registered mail, which means ordered items are insured against loss during delivery. Additional costs for packaging may be charged. Sending items without registering is possible, but in that case Tramshop does not accept responsibility for loss or damage during delivery.
Article 8
When customer returns a defective item to Tramshop, he will receive a replacement. If the article is not available, customer will get his payment back. This only applies for articles which are returned within a period of ten working days. Tramshop does not accept returned items which are defective because of improper use.
Article 9
Delivered items and/or services are offered in good faith, based on information given by the suppliers. Customer may cancel the order by informing of this intention in writing up to seven working days from the day of ordering. Goods are to be returned at customer's responsibility and expense in an unused condition in the original packaging. Tramshop can require that customer repairs, replaces or delivers any failing parts or elements of the item. A refund will follow within fourteen days after Tramshop has received the returned item.
Article 10
Tramshop operates under Dutch law. If any interpretational differences arise over the text of these terms and conditions, the Dutch text will prevail.
